A Complainant is not a Prosecutor and definitely not the Defendant
Most people hear “court case” and instantly label everybody “accused,” “suspect,” or “defaulter” but in law, everyone in a criminal case has a specific role and mixing them up shows you don’t understand the process.
Let me explain it in simple, everyday language.
The Complainant is the person who reports the matter. The victim. The person who goes to the Police to say something wrong was done to them.
They bring the issue forward but once the case enters the system, they cannot control it anymore.
The Prosecutor is the lawyer representing the state, not the complainant. Once a criminal matter begins, it becomes The State vs. The Defendant because crime is considered an offence against society, not just the individual. The prosecutor is the one who argues the case, calls witnesses, presents evidence, and tries to prove guilt.
The Defendant on the otherhand, is the person standing trial. The person the state is accusing of an offence. Before court, they may be called “suspect.” Inside court, they are called defendant and the law presumes them innocent until proven guilty.
So the structure is simple
🥢 The complainant reports.
🥢 The prosecutor proves.
🥢 The defendant answers.
Know the difference.
Use the right terms.
And stop calling everyone in court “accused” the law has clear roles.
