That an evidence to be presented before the court in connection to any fact in issue to either prove or to disprove a fact in issue is a question of Availability and whether such an evidence is available is a question of fact...In this sense the question of the best evidence rule come into play, And what then amount to the best evidence...it is that which is available. that which is available is the best at that material point in time to either prove or to disprove a fact in issue. see the illustrative case of Adamu v.
