【房产单元●买屋需知】马来西亚发展商 HDA 房屋买卖合约。

什么是 HDA 房屋买卖合约? 有个朋友Mr Lim 要跟发展商(developer)买屋子，他们两公婆计划跟银行借钱，可是却担心发展商拿了钱，而没有建屋子，那么他们就欠银行贷款了。他们问，银行是否一批贷款就把钱直接给发展商了？如果房屋还没建好，是否有风险？

当然他们也可能担心遇到发展商迟交房屋，或有关的房屋工程停顿，甚至发展商倒闭。因此，我在这里跟大家分享我所知道的买卖房屋的皮毛知识。（如果有错，请纠正我哦）。

跟发展商买屋子是一手市场的房屋，标准的买卖合约 (Sales and Purchase Agreement) 是1966年的屋业发展（控制及执照）法令 (Housing Development Act 1966, HDA)管辖范围内，因此必须使用 HDA 设定的标准买卖合约。

其中，发展商必须从合约日期起的24个月 (有地房屋) 或36个月(分层建筑物)内，包空移交给购屋者。

先售后建 如何付款

在先售后建的形式下，购屋者必须在建筑期间分期根据建筑的进展，有关的进展必须根据《Schedule G》 附表G（个别分割地契）或《Schedule H》附表H（分层建筑物）来缴付购买价。

以下是 Schedule G 的付款表:

● Immediately upon the signing of this.
Agreement – 10%
● the work below ground level including piling and foundation – 10%
● the reinforced concrete framework and floor slab – 15%
●door and window frames placed in position – 10%
● the roofing/ceiling,electrical wiring, plumbing – 10%
● the internal and external plastering – 10%
the sewerage works serving – 5%
● the drains – 5%
● the roads – 5%
● water and electricity supply ready – 12.5%
