Buying a site step by step
1. Identify the site.
2. Verify the site [meet the chief, council officer of the area; check with LAA if its registered] ask: -
2.1 who is the owner of the site?
2.2 how did the owner get ownership?
2.3 what is the short history of the site?
2.4 are there documents to proof the all the above?
2.5 what kind of documents are they?
2.6 when were the documents acquired?
2.7 etc
3. Sign a deed of sale [preferably with a lawyer]
4. Pay the purchase price into lawyer’s trust account
5. Apply for consent to transfer
6. After consent is issued by LAA sign the transfer papers
7. Original lease and transfer papers be left in the hands of the lawyer doing transfer
8. Process the transfer
9. Pay stamp duty
10. Get approval of the transfer
11. Let the lawyer pay the seller with the money held in trust
12. The money be paid to the personal account of the seller
13. If money is paid to bank account of the seller/agent (get a surety agreement that says the seller / agent/ director of the company shall be personally liable or personal assets can be used to recover loss if any).
14. Occupy the site registered in your names.
15. Build a toilet, plant maize, fence the site. SHOW THAT YOU ARE IN OCCUPATION.
Additional TIPS
16. Be careful around Khubetsoana, Abia and Qoaling sometimes fraud happens inside the Chief’s office. If your chief wants to sue me for defamation tell him or her I am ready.
17. Don’t buy from estate agent who was wants quick cash
18. Don’t buy from seller who wants quick cash
19. Don’t pay deposit where the seller has no lease
20. *Around Mabote project there is double allocation. There is also double allocation some parts of Ha Thamae, Qoaling and Thabong.
21. Don’t pay money for buying sites without involving lawyers (to buy a site with assistance of lawyer is not costly if you do proper preparations). It is expensive to fight for a site in a court of law when you were not cautious when buying.
