Important IBC Judgments by the NCLTs (16-20 August 2021) Summaries of the important and noteworthy judgments by the NCLT benches on various legal issues under IBC.

The Report of the Parliamentary Standing Committee on Finance had criticised IBC as deviated from its original goals and flagged the haircuts taken by lenders as a major concern. However, a key stakeholder of the IBBI had countered this by delay factor.

The haircut that never was: Need to factor in whether a loan account had become an NPA while assessing haircut from its resolution under IBC A delay in initiating the insolvency process also means that creditors, because of their unhappy experience, are more inclined to take back their money with whatever haircut comes about and make their exit.
