During the 1992 securities scam, when courts and creditors seized all of Harshad Mehta's assets, his ₹10 crore life insurance policy remained completely untouched.
It was secured under the Married Women’s Property (MWP) Act, 1874.
How the MWP Act Protected the PolicyLegal Shield: Section 6 of the MWP Act treats a life insurance policy as a trust for the exclusive benefit of the policyholder's wife and children.
Untouchable Asset: Because the policy belongs directly to the family, no court, bank, tax authority, or creditor can seize it, even in the event of bankruptcy or severe legal liabilities.
Nomination vs. Ownership: Under normal circumstances, a nominee is just a caretaker of the funds. By registering under the MWP Act, the wife and children become the absolute owners of the payout.
