Residents’ public encroachment on roadways involves individuals or households unlawfully extending their property or activities into public roads. Common examples include building ramps, gardens, fences, parking private vehicles, or placing personal items on streets meant for public use.

Consequences:
1. Obstruction of Traffic: Encroachments narrow road space, leading to traffic congestion and restricted movement for vehicles and pedestrians.
2. Emergency Access Issues: Blocked roads can delay the response time of ambulances, fire services, and police during emergencies.
3. Pedestrian Inconvenience: Sidewalks or walking paths occupied by residents force pedestrians onto roads, increasing the risk of accidents.
4. Unfair Use of Public Property: It gives certain residents an unfair advantage over others by privatizing shared community spaces.
5. Hindrance to Infrastructure Development: Encroachments can delay road repair, utility work, and city planning projects.

Addressing such encroachments is vital for maintaining safety, fairness, and functionality in urban neighborhoods.

Section 114. Penalty for encroachment on public roads, etc.

Any person, who without the permission of the Nagar Panchayat or of the Council, β€”
(a) encroaches upon any public road or house-gully or upon any public drain, sewer, aqueduct, v water-course or that by
making any excavation or by erecting any wall, fence, rail, post, projection or other obstruction, or by deposing any movable property thereon, or
(b) takes up or alters the pavements or other materials, fences or posts on any public road,
shall, for every such offence, be punishable with fine not exceeding two thousand and five hundred rupees and with a further fine not exceeding two hundred rupees for every day during which the encroachment continues after the first conviction.
