My Legal Rights
Can the law decide when a woman should stop dreaming of motherhood?
A powerful constitutional debate has reached the Bombay High Court.
Two women aged 53 and 55 challenged the age restriction under assisted reproductive laws — arguing that reproductive choice, dignity, and personal liberty are fundamental rights under Article 21 of the Constitution.
The Court has now allowed them to undergo medical evaluation.
This case is bigger than age.
It is about:
⚖️ Bodily autonomy
⚖️ Right to motherhood
⚖️ Personal liberty vs State control
Sometimes law creates boundaries.
And sometimes constitutional rights challenge them.
The real question is:
Should the State decide a woman’s reproductive choices?

🚨 Allahabad High Court on “Burqa Row” – What exactly happened?
A case came before the Allahabad High Court where an FIR was registered against two Class 12 students under the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021.
📌 Allegation:
A Hindu student claimed that her classmates pressured her to wear a burqa and convert her religion.
📌 What did the accused do?
They approached the High Court seeking quashing of the FIR, arguing that the case was false and fabricated.
⚖️ What did the Court decide?
The Allahabad High Court refused to quash the FIR at this stage and made a strong observation:
👉 The growing tendency among youth to impose their religious beliefs on others is a “disturbing trend.”
The Court further held:
✔️ Prima facie offence is disclosed
✔️ Investigation must continue
✔️ FIR cannot be quashed at the initial stage
📖 Legal Position:
Courts do not examine disputed facts in writ jurisdiction.
If allegations disclose an offence, the matter must go through investigation and trial.
📌 Why this case matters:
This case touches upon:
• Religious freedom vs coercion
• Scope of anti-conversion laws
• Limits of High Court’s power in quashing FIR
💬 Takeaway:
Quashing of FIR is not routine.
If there is a prima facie case, law will take its course.
