π Today I read a very important news article and thought of sharing it with you all:
π The Bombay High Court has given an important judgment regarding health insurance claims.
Here are the key points as per my understanding:
β’ The 90-day time limit for filing insurance claims is not considered fully valid now.
β’ A claim cannot be rejected only because it was filed late.
β’ In this case also, the claim was rejected as it was submitted after 90 days.
β’ The Court clearly said that such rejection is against the law.
β’ As per the Indian Contract Act, no clause can take away a personβs legal rights.
β’ The insurance company referred to an old Supreme Court judgment, but it was not accepted here.
β’ An insurance policy is a contract, but customer rights must be protected.
β’ Many times, hospital bills are received late, so timely submission becomes difficult.
β’ The Court directed the insurance company to settle the claim.
β’ Overall, this judgment is very positive for policyholders.
β
My Personal Opinion:
Now, it will not be easy to reject claims only on the basis of βlate submission.β
However, I would still suggest that we should inform the insurance company on time. And if there is any delay, it is important to submit the claim with proper justification and supporting documents.
