š” Assessing Mental Capacity to Sell a House
One of the most common reasons weāre asked to carry out a capacity assessment is when someone needs to sell their home ā often because they now require ongoing care or support.
This decision can be complex, especially when the person has dementia or cognitive difficulties. Selling a property isnāt just a financial transaction ā it involves understanding the value of the home, where the person will live next, and how the proceeds will be used for their care.
ā
At Gain Capacity Experts, we provide clear, independent assessments to determine whether someone has the mental capacity to make this decision.
š We take time to explain the process in simple terms, involve loved ones appropriately, and always act in the personās best interests.
If youāre a solicitor, social worker, or family member navigating this situation, weāre here to help.

šāØ After a full-on week of capacity assessments across the country, I'm very glad itās Friday!
Yesterday took me to Surrey ā a 3-hour train journey each way ā to carry out an in-person mental capacity assessment. Despite the long travel, itās always rewarding to meet people face-to-face and ensure that every assessment is thorough, respectful, and person-centred.
This week Iāve supported decisions relating to finances, health and welfare, and even testamentary capacity. Each situation is different, and itās a privilege to be trusted with such important matters.
Now itās time for a cuppa and a well-earned rest before doing it all again next week!

š§ š¬ How Does Dementia Affect Mental Capacity? š¬š§
At Gain Capacity Experts, we often work with individuals living with dementiaāand one of the most common questions weāre asked is:
š āHow does dementia impact a personās mental capacity?ā
Dementia is a progressive condition that affects how the brain works. Over time, it can impact a personās ability to:
ā
Understand and retain information
ā
Make informed decisions
ā
Weigh up options and consider consequences
ā
Communicate their choices clearly
This can make everyday decisionsāabout money, healthcare, or living arrangementsāmore difficult or even impossible without the right support.
Itās important to remember that mental capacity is decision-specific. A person with dementia may still have capacity to make some decisions but not others, especially as the condition progresses.
Thatās where we come in. At Gain Capacity Experts, we carry out independent, expert mental capacity assessmentsāalways with compassion, clarity, and respect.
š” If youāre concerned about a loved oneās capacity to make decisions or need a formal assessment for legal purposes (like for a COP3), get in touch. Weāre here to help.
