Could a broken wrist land your driver in prison … and your company in the spotlight?

Since being introduced in 2022, the offence of Causing Serious Injury by Careless Driving means causing the type of injuries to another person that would previously have attracted a fine and penalty points, can now result in a driver receiving a custodial sentence and a lengthy driving disqualification, and potentially trigger a Health and Safety Executive investigation against the company.

During 2023, commercial vehicles* were involved in more than 4,500 incidents where a casualty was seriously injured and in almost one in every three road fatalities .

For fleet operators, this isn’t just a statistic. It’s a call to action. With risks this high, having 24/7 access to specialist legal support isn’t just sensible, it’s essential.

Don’t wait until it’s too late. Talk to us today about how LMP FLEET 24/7 Crisis Support keeps your drivers - and your business - legally protected.

Driver wellbeing: more than just a passing conversation

What happens in the first few minutes after a serious road traffic incident, what we call the "Golden Minutes", can result in serious legal consequences for drivers and their employers. What a driver says whilst vulnerable and in shock can make or break a case.

However, driver and employer responsibilities start long before the driver even steps foot into their cab, as outlined during a recent inquiry before the Traffic Commissioner following a bridge strike – a case that laid bare the consequences of poor planning and failing to take into account or prioritise driver wellbeing.

In order for employers to minimise the risk of a serious incident occurring in the first place, company policies and procedures should take into account not only a driver’s physical wellbeing or medical condition, but also their emotional and mental wellbeing and any personal circumstances that may impact their ability to properly concentrate or drive safely. Failure to do so may be exposing businesses to significant risk.

At LMP Legal, we work with fleets across the UK to help them implement proactive, preventative policies that don’t just tick boxes, but go above and beyond to protect people and reputations.

This is a must-read from Senior Associate, Chrissy O'Connor if you're responsible for a business fleet.
