Changes to Skilled Worker visa requirements could have a significant impact on both migrant workers and UK employers 🇬🇧🌏

In Suffolk News , Sohan Sidhu, Ellisons' Partner and Head of Immigration, discusses the upcoming change requiring migrant workers applying under the Skilled Worker route to meet a B2 level of English, rather than the previous B1 requirement.

This is an important shift for businesses that rely on international recruitment. Migrants will need to meet the B2 requirement at the point they apply for a Skilled Worker visa, meaning employers may need to factor this into their recruitment timelines, sponsorship planning and wider workforce strategy.

As Sohan explains: “This marks a significant shift for both migrants and their prospective UK employers.”

Recent changes to UK immigration rules have significantly increased minimum salary thresholds for Skilled Workers.

While designed to reduce net migration, these changes are creating real challenges for employers, particularly where existing sponsored employees no longer meet the revised requirements for visa extension.

A recent Employment Tribunal decision, Surya Dhakal v Fintru Limited, provides valuable guidance for employers navigating this complex situation lawfully and fairly.

Key lessons for employers include:

✅ Engage early with affected employees
✅ Seek specialist immigration advice
✅ Explore alternatives such as salary increases, redeployment or relocation
✅ Hold meaningful consultation meetings
✅ Keep clear records of all decisions
✅ Follow a structured dismissal and appeal process

For further information on how employers can manage Skilled Worker salary threshold issues and right to work challenges fairly, read our latest article by Sohan Sidhu.
