Insurance Brokers remind the public that train passengers are covered by the Mandatory Passenger Insurance (Seguro Obligatorio de Viajero), regulated by Royal Decree 1575/1989 of 22 December, which approves the Regulation of the Mandatory Passenger Insurance.

This insurance covers “bodily injuries suffered by any person who, at the time of the accident, holds a valid transport ticket,” including death, permanent or temporary disability of the insured person, as well as medical assistance. In the event of death, the beneficiaries are determined in the following order: spouse, descendants or parents of the deceased. The compensation amounts are established according to the annex of the aforementioned Royal Decree 1575/1989.

Furthermore, Royal Decree 627/2014, on assistance to victims of railway accidents and their families, establishes a compensation scale for the Mandatory Passenger Insurance in railway transport that doubles the compensation amounts provided for passengers of other forms of collective transport.

Regardless of the Mandatory Passenger Insurance, the party responsible for the accident must compensate victims and affected parties through their civil liability insurance, with possible deductibles applicable. The amounts, categories and beneficiaries are determined according to the motor vehicle traffic compensation scale regulated by Legislative Royal Decree 8/2004 of 29 October.

Victims and affected parties may file judicial or extrajudicial claims, and in many cases these can be pursued through legal defense coverage included in home insurance, legal defense insurance, or other policies that cover such claims.
