County Conservancy
Following the release of the terms of settlement between Prince Edward County and Picton Terminals the County Conservancy retained a legal firm who has expertise in Municipal Law. The result is a letter produced by Goodmans on behalf of the County Conservancy challenging the legality of the agreement between PEC and PT. We were told by County Counsel on July 23 that the agreement had been accepted by PT and was now 'legally binding'. This may not be true. Today August 19th the Mayor and County Council have received copies of the letter. This opinion will no doubt be challenged by Council and County lawyers. The County Conservancy has suggested the County obtain the opinion of a third party law firm before deciding on next steps. While this is encouraging, we must continue to reach out to our Council letting them know that we oppose back room deals and secret agreements without public consultation. Stay tuned.
If you are confused you are not alone. The courts have taken their time to hear the case between Prince Edward County and Picton Terminals. This long delay has resulted in increased legal costs for both sides. The County filed an Application for Permanent Injunction October 5, 2022. The courts may hear this case in November. Far too long. The County is simply asking Picton Terminals to abide by the laws and bylaws of the County. I pay my taxes each year on time and so do you. So why is it so difficult to get Picton Terminals to abide by the law. Well, that's why we have courts and lawyers. Once again Picton Terminals is proving themselves to be a liability rather than an asset to our area. County Council made a decision on Tuesday to try once again to negotiate a settlement with this rogue operator. They tried last year but with no success. Why bother negotiating, it is the law. Increase the fines and follow through on legal action. It is time for Picton Terminals to get in line and stop being a nuisance to the residents of this County. We have put up with noise, light and chemical pollution of our Bay and properties. I ask again as I have many times in the past, 'What benefit does Picton Terminals provide the County?'
The answer is Nothing!
It is time once again to write your councillor and tell them to get tough on Picton Terminals. Please do so for the sake of our environment.
