Brar v. Canada (Citizenship and Immigration), 2026 FC 631
A worker's permanent residence application under the Agri-Food Pilot Program was refused because the officer concluded his employer did not operate in an eligible industry.
After receiving a Procedural Fairness Letter, the applicant submitted additional evidence showing the employer primarily operated eligible greenhouse and vegetable production. However, the officer largely ignored this evidence and instead relied on internet research and Google Maps.
The Federal Court found the decision to be unreasonable because the officer failed to properly consider the applicant's evidence or explain why it was rejected. The application for Judicial Review was allowed, and the matter was sent back for reconsideration by a different officer.
Lesson: Immigration officers must fairly assess all relevant evidence and provide clear reasons for rejecting it.
