The Supreme Court of Canada has recently recognized the tort of intimate partner violence in the decision Ahluwalia v. Ahluwalia.

At trial, the Court recognized a new tort of family violence, designed as an “umbrella tort” to capture the full pattern of abuse in a family context in response to a claim for tort damages arising from a 16‑year pattern of intimate partner abuse.

This new tort acknowledges that intimate partner violence often involves a sustained course of coercive, controlling, and psychologically harmful behaviour, rather than isolated incidents. As a result, survivors who have experienced such patterns of abuse can now seek compensation from their abuser for the full scope of the harm suffered.

Read Dylan Snowdon's most recent case analysis, where he outlines the elements of the new tort, discusses how limitation periods apply, and explains why this matters in practice: https://lnkd.in/gpEpd2q6

At Carbert Waite LLP, we’re proud to support the people and passions that make up our team - both on and off the field.

Davud, one of our lawyers, is a dedicated supporter of Bordo Turks FC in CUSA Division 4A. It’s a team built on commitment, culture, and community - values that translate just as well on the pitch as they do in practice.

What makes this connection even more meaningful is the cultural significance behind the game. Today, on May 19, Türkiye observes Commemoration of Atatürk, Youth and Sports Day - a national holiday marking the beginning of Mustafa Kemal Atatürk’s leadership in the Turkish War of Independence in 1919. It is a day of profound national significance, celebrating youth, sport, unity, and the foundations of modern Türkiye.

We’re proud to sponsor Davud’s team and support the spirit of sport that brings people together in Calgary and beyond.
