From 1 July 2026, real estate agents will be required to carry out customer due diligence on buyers and sellers under new Anti-Money Laundering and Counter-Terrorism Financing legislation.
This is a legal requirement introduced by the Australian Government and is intended to help protect Australia’s property market from criminal activity.
For sellers, customer due diligence will take place when you list your property with an agent. It must be completed before the property can be advertised.
For buyers, these customer due diligence will begin once your offer to purchase a property has been accepted.
Customer due diligence may include verifying your identity, checking whether you are a politically exposed person or on sanctions lists, and asking about your reasons for buying or selling. In some cases, agents may also need to ask about your source of funds or wealth.
If you are buying or selling through a trust or company, the agent will also need to confirm the beneficial owners.

May Market Update: The time taken to sell a property in Perth has nearly doubled in the past three months, according to reiwa.com data.
REIWA President Suzanne Brown says the market had eased over the past two months. An increase in new listings, shifting buyer sentiment and three consecutive rate rises have given buyers more choice and made them more discerning.
“As a result of these changes, properties are taking slightly longer to sell,” she says.
“Conditions vary from suburb to suburb, so if you are thinking of selling, I recommend you speak with your local REIWA agent about market activity in your area.”
