Lately, numerous new homeowners have been receiving correspondence concerning recent legislation changes and temporary fencing. We would like to express our gratitude to one of our clients who shared her response from DMIRS (Department of Mines, Industry Regulation and Safety) regarding this matter.

The use of temporary site security fencing is not prescribed in regulation 298 of the WHS Regulations 2022. If a risk assessment identifies that security fencing is required in order to comply with the regulation by both securing the workplace from unauthorised access and isolating the risk to health and safety arising from unauthorised access; then a risk assessment should be conducted as to whether fencing can be removed.

For the internal area of a dwelling at lockup stage, fencing is not required. However, if the risk assessment determines that the remaining area of the site is still a workplace and contains scaffolding, excavations, stored chemicals, plant and equipment, a pool, etc. then regulation 298 applies.
