🛡 NDIS Suitability Assessment: What Providers Really Get Assessed On 👀

Before you’re approved (or renewed), the NDIS Commission runs a formal Suitability Assessment on:
🏢 your organisation + 👥 your key personnel.

📘 What is the NDIS Suitability Assessment?
It’s a mandatory check used by the NDIS Commission to decide whether your organisation and your key personnel are fit to deliver NDIS supports and services. It applies to new registrations and renewals, and it’s assessed case-by-case using what you submit in the application.

👥 Who Gets Assessed?

Two groups:
🏢 The Provider (your business)
AND
👥 Key Personnel (this includes directors, CEOs, managers, board members, and anyone in senior operational roles).

🏢 Provider Suitability: What They Check
This is the “business risk profile” scan:
❌ Past banning orders
⚖️ Criminal convictions
💸 Insolvency history
🏛️ Regulatory action (ASIC, ACCC, ACNC, AUSTRAC, WHS, etc.)
🚨 Fraud, dishonesty, or misrepresentation findings
📉 Disqualification from managing corporations

Plus: any other matter the NDIS Commissioner considers relevant.

👔 Key Personnel Suitability
Each director or senior person is also reviewed for:
🚫 Banning orders
⚖️ Indictable offences
💸 Insolvency
🏛️ Regulator action
🚨 Fraud/dishonesty
📉 Corporate disqualification

The NDIS Commission has clarified its expectations under the NDIS (Practice Standards – Worker Screening) Rules 2018 (effective from 31 March 2025).

Here’s what auditors will now expect to see 👇

🔒 𝐖𝐡𝐚𝐭’𝐬 𝐧𝐨𝐰 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐝

All new NDIS applicants must ensure every worker in a risk-assessed role holds a valid NDIS Worker Screening Clearance.

Risk-assessed roles include:
• Workers delivering NDIS supports
• Staff or key personnel with more than incidental contact with people with disability (contact includes physical, face-to-face, phone, written, or electronic communication)

📋 𝐖𝐡𝐚𝐭 𝐚𝐮𝐝𝐢𝐭𝐨𝐫𝐬 𝐰𝐢𝐥𝐥 𝐜𝐡𝐞𝐜𝐤 (𝐚𝐧𝐝 𝐟𝐚𝐢𝐥 𝐲𝐨𝐮 𝐟𝐨𝐫)

Auditors must issue a non-conformity if:
❌ Any risk-assessed worker lacks a valid clearance
❌ You can’t show how worker screening is monitored or managed

You’ll need to demonstrate that you:
✔ Understand what a risk-assessed role is
✔ Have workers linked in the Worker Screening Database
✔ Track clearance status and expiry dates
✔ Act immediately if a clearance is suspended or revoked

Worker Screening is now a high-risk audit focus area.
