๐Ÿ›ก NDIS Suitability Assessment: What Providers Really Get Assessed On ๐Ÿ‘€

Before youโ€™re approved (or renewed), the NDIS Commission runs a formal Suitability Assessment on:
๐Ÿข your organisation + ๐Ÿ‘ฅ your key personnel.

๐Ÿ“˜ What is the NDIS Suitability Assessment?
Itโ€™s a mandatory check used by the NDIS Commission to decide whether your organisation and your key personnel are fit to deliver NDIS supports and services. It applies to new registrations and renewals, and itโ€™s assessed case-by-case using what you submit in the application.

๐Ÿ‘ฅ Who Gets Assessed?

Two groups:
๐Ÿข The Provider (your business)
AND
๐Ÿ‘ฅ Key Personnel (this includes directors, CEOs, managers, board members, and anyone in senior operational roles).

๐Ÿข Provider Suitability: What They Check
This is the โ€œbusiness risk profileโ€ scan:
โŒ Past banning orders
โš–๏ธ Criminal convictions
๐Ÿ’ธ Insolvency history
๐Ÿ›๏ธ Regulatory action (ASIC, ACCC, ACNC, AUSTRAC, WHS, etc.)
๐Ÿšจ Fraud, dishonesty, or misrepresentation findings
๐Ÿ“‰ Disqualification from managing corporations

Plus: any other matter the NDIS Commissioner considers relevant.

Each director or senior person is also reviewed for:
๐Ÿšซ Banning orders
โš–๏ธ Indictable offences
๐Ÿ’ธ Insolvency
๐Ÿ›๏ธ Regulator action

๐Ÿ“‰ Corporate disqualification

The NDIS Commission has clarified its expectations under the NDIS (Practice Standards โ€“ Worker Screening) Rules 2018 (effective from 31 March 2025).

Hereโ€™s what auditors will now expect to see ๐Ÿ‘‡

All new NDIS applicants must ensure every worker in a risk-assessed role holds a valid NDIS Worker Screening Clearance.

Risk-assessed roles include:
โ€ข Workers delivering NDIS supports
โ€ข Staff or key personnel with more than incidental contact with people with disability (contact includes physical, face-to-face, phone, written, or electronic communication)

๐Ÿ“‹ ๐–๐ก๐š๐ญ ๐š๐ฎ๐๐ข๐ญ๐จ๐ซ๐ฌ ๐ฐ๐ข๐ฅ๐ฅ ๐œ๐ก๐ž๐œ๐ค (๐š๐ง๐ ๐Ÿ๐š๐ข๐ฅ ๐ฒ๐จ๐ฎ ๐Ÿ๐จ๐ซ)

Auditors must issue a non-conformity if:
โŒ Any risk-assessed worker lacks a valid clearance
โŒ You canโ€™t show how worker screening is monitored or managed

Youโ€™ll need to demonstrate that you:
โœ” Understand what a risk-assessed role is
โœ” Have workers linked in the Worker Screening Database
โœ” Track clearance status and expiry dates
โœ” Act immediately if a clearance is suspended or revoked
