Many buyers and sellers often wonder about occupational rent.

Occupational rent is a pro-rata monthly rental amount the buyer pays to the seller if they take early occupation, that is, if they move into the property before the transfer is officially registered in their name. The parties can agree on when occupation will take place.

Our team clearly explains this from the beginning so both buyer and seller know exactly what to expect and there are no surprises later.

If there is a court interdict (or caveat) against the property or the seller, the Deeds Office will not permit registration until it has been lifted.

An interdict is a court order that freezes the property, preventing its sale or transfer until the underlying issue, such as unpaid debt, has been resolved. This can often comes as a surprise to families during estate transfers.

Many people assume the bank will automatically cancel the bond once it’s fully paid up.

The truth is, the bank will not cancel the bond automatically. A formal request must be made to the bank, after which a conveyancer needs to be appointed to handle the cancellation.

This involves a fee and lodging the cancellation documents at the Deeds Office to officially remove the bond from the title deed. If not planned properly, this extra step can cause unexpected delays.
