Is it a GOOD idea to leave Your Spouse and Adult Children Joint Owners of the family home ?
You’ve been married for 30 years, and your spouse has been by your side. But you also have children from a previous marriage. Then, unexpectedly, you pass away. According to your trust, your spouse now owns 50% of the home you shared, while your adult children inherit the other 50%.
Sounds fair, right? Maybe not.
This setup can create major conflicts—especially if:
❌ Your spouse can’t afford to buy out the adult children’s share.
❌ Your children and spouse don’t get along.
❌ The children force a sale through a partition action.
❌ The surviving spouse alienates the children during the grieving process.
As an appraiser, I’ve seen firsthand how often these situations turn ugly. Losing a loved one is hard enough—fighting over a home makes it even worse.
