When you buy a home, you should be able to trust that it was built safely and correctly.

AB 1903 would make significant changes to California’s construction defect laws for new condos and townhomes.

Supporters say the bill will encourage more housing construction, but those who oppose it are concerned it could make it harder for homeowners and homeowners associations to hold builders accountable when serious defects are discovered.

Construction defect laws exist to protect families from costly problems such as water intrusion, structural issues, mold, and other defects that may not become apparent until years after a home is purchased. For many homeowners, legal remedies are often the only way to ensure repairs are completed and costs are not unfairly shifted to residents.

Although many argue California needs more housing, we also need strong consumer protections. Expanding homeownership should not come at the expense of homeowner rights, building quality, or accountability.
