Three GOP lawmakers just filed amendments to stop the federal recriminalization of h**p THC products — one would delay the ban two years, one would block enforcement funding entirely, and one (the Lawful H**p Protection Act) would establish a real regulatory framework with labeling, age verification, and THC limits.

The House Rules Committee decides next week what makes it to a vote. Call your legislators- tell them to support these bills.

May 28, 2026 - Understandably, there has been significant confusion surrounding the legal status of delta-8 in Texas with the injunction getting lifted today.

As discussed in a recent video update, the current legal interpretation from counsel involved in the Sky Marketing case is that the lifting of the injunction does NOT automatically make delta-8 illegal overnight. Their position is that DSHS would likely need to complete additional administrative steps before delta-8 could formally be scheduled or banned.

At the same time, much of the public conversation around delta-8 has been driven by misleading terminology and confusion around how these cannabinoids are actually produced.

Many people are surprised to learn:
• Delta-8 exists naturally in h**p
• Many cannabinoids are commercially produced through conversion processes
• Similar synthesis methods are commonly used throughout the food, supplement, and pharmaceutical industries

The real conversation should be about product standards, testing, transparency, and consumer safety — not fear-based narratives designed to confuse the public.

This post reflects the current legal interpretation of counsel involved in the Sky Marketing case and is not official guidance from the state. It is still recommended to sell through delta-8 products and not restock or produce more at this time.

A lot is happening in Texas h**p right now, and misinformation spreads fast.

The biggest thing to understand: not every court deadline means an immediate change in enforcement or legality.

We’re continuing to monitor both the THBC vs DSHS case and the Sky Marketing Delta-8 injunction closely and will keep the industry updated as developments happen.

Businesses should stay informed, stay compliant, and prepare for multiple outcomes as these cases continue to unfold.

The Injunction has been reinstated until next Thursday.
That is the deadline by which the state has to respond.
Until Thursday, May 14th, the injunction is effective again and the challenged rules are no longer active.

We’ll advise when we know more.

05/06/2026

May, 6, 2026 The state filed its notice of appeal in the THBC lawsuit against DSHS. We anticipated the state doing this.

Our legal counsel has alerted the 15th Court of Appeals we will be filing the Rule 29.3 motion as soon as we are assigned a docket number in that court.

We will be working to provide relief to the industry as fast as possible. This process could take anywhere from 1-3 weeks.

Today, a Texas court granted a temporary injunction in the Texas H**p Business Council (THBC) lawsuit against the Texas Department of State Health Services (DSHS) to all commercial members of the industry.

We recognize that further proceedings are likely, including an appeal by the State. We are prepared to defend the Court’s ruling and will continue working to maintain the injunction and its full scope to protect Texas businesses, consumers, and the rule of law.

Day 2 update: The injunction hearing concluded with impactful testimonies & solid representation.

State witnesses & closing arguments are slated for tomorrow. The judge anticipates delivering a decision by Friday 💪🏽.

The hearing is now scheduled for April 28–30, and the Temporary Restraining Order (TRO) remains in effect.

The court date was extended to ensure sufficient time to fully present the case. Our legal team at Butler Snow determined that one day would not be enough to cover the complexity and importance of the issues at hand. This additional time allows for a more thorough presentation and strengthens our ability to achieve a favorable outcome.

A Temporary Restraining Order has been granted to THBC against the state on select rules.

It will last for about two weeks as we head into a Temporary Injunction hearing on 4/23/26.
