حالیہ عدالتی فیصلوں میں یہ واضح کیا گیا ہے کہ اگر محکمہ انکم ٹیکس صرف IRIS پورٹل پر نوٹس یا آرڈر اپلوڈ کرے تو اسے بذاتِ خود مؤثر قانونی سروس (Valid Service) نہیں سمجھا جائے گا۔
یہ اصول مختلف مقدمات میں اپیلیٹ ٹربیونل ان لینڈ ریونیو (ATIR) اور فیڈرل ٹیکس محتسب (FTO) نے واضح کیا ہے۔
قانون کیا کہتا ہے؟
Income Tax Ordinance, 2001 — Section 218
قانون کے مطابق نوٹس کی سروس کے لیے مخصوص طریقے مقرر ہیں، مثلاً:
رجسٹرڈ ڈاک
کوریئر
ذاتی تعمیل
عدالتی مؤقف کے مطابق، صرف IRIS پر اپلوڈ کرنا اس وقت تک کافی نہیں جب تک دیگر قانونی طریقے بھی اختیار نہ کیے جائیں۔
اگر:
آپ کے خلاف Ex-Parte اسیسمنٹ آرڈر پاس ہوا ہو
آپ کو کسی کارروائی کا بروقت علم نہ ہوا ہو
نوٹس صرف IRIS پر اپلوڈ کیا گیا ہو
تو آپ کے پاس قانونی چارہ جوئی کا مؤثر حق موجود ہو سکتا ہے۔

موصول شدہ نوٹسز کی تاریخیں تصدیق کریں
