β€’ May legal agreement na nagpapatunay ng karapatan mo sa lupa

Ayon sa Article 448 ng Civil Code ng Republic of the Philippines:

Kung nagtayo ka ng bahay sa lupa ng iba, ang may-ari ng lupa ang may karapatan na angkinin ang bahay, pero kailangan ka niyang bayaran ng tamang halaga, o kaya naman ay obligahin kang bilhin ang lupa kung maaari.

β€’ Puwede mong mawala ang bahay
β€’ Hindi garantisadong mababayaran ang ginastos mo

Ito ang tinatawag na builder in bad faith sa batas.

π—œπ— π—£π—’π—₯π—§π—”π—‘π—§π—˜π—‘π—š 𝗧𝗔𝗑𝗗𝗔𝗔𝗑:

Sa ilalim ng Property Registration Decree (PD 1529), ang legal owner ay ang taong nakapangalan sa titulo na naka-register sa Land Registration Authority.

Ibig sabihin, ang titulo ang pinakamalakas na patunay ng pagmamay-ari, hindi tax declaration, hindi resibo, at lalong hindi verbal agreement.

Puwede kang magpatayo kahit hindi nakapangalan sa iyo ang lote, pero kung wala kang legal na karapatan, nasa panganib ang buong investment mo.
