If you employ someone as a permanent employee, you must:

✅ Provide a compliant employment agreement.
✅ Meet minimum employment standards, including leave entitlements and the minimum wage.
✅ Deduct PAYE and meet your employer obligations.
✅ Act in good faith and follow fair employment processes.
✅ Keep accurate wage, time and leave records.

If you engage someone as a contractor, you should:
🔹 Have a clear contractor agreement.
🔹 Pay invoices rather than wages.
🔹 Ensure they genuinely operate as an independent business.
🔹 Avoid treating them like an employee by controlling every aspect of how they work.

⚠️ Getting it wrong can be costly. If someone is found to be an employee rather than a genuine contractor, your business could be liable for unpaid leave, KiwiSaver contributions, PAYE issues and other employment entitlements.
