Following the 20 November 2025 judgment by Justice James Omotosho, which sentenced Nnamdi Kanu to life imprisonment on terrorism charges, legal experts and the defense team identified numerous alleged errors. The 101-count appeal filed thereafter aims to overturn the verdict, citing serious procedural and jurisdictional defects that they argue make the ruling a nullity.
Key alleged errors in the judgment include:
Reliance on Repealed Law: The judgment allegedly convicted Kanu under the Terrorism Prevention (Amendment) Act 2013, which had been replaced by the Terrorism Prevention and Prohibition Act 2022.
Extraordinary Rendition: The court reportedly ignored evidence of illegal rendition from Kenya, which violates international treaties (OAU Convention) and Nigerian Law.
Introduction of Extraneous Claims: The judge allegedly included accusations not contained in the original charges—such as plans to bomb foreign embassies—violating judicial ethics.
Violation of Fair Hearing: The court reportedly rushed the judgment while multiple appeals on jurisdiction and admissibility of evidence were still pending, and denied the defendant the right to properly present a defense.
Jurisdictional Defects: The judgment allegedly failed to properly rule on the court’s competence to try the case, given the unlawful nature of the defendant's return to Nigeria.
Double Jeopardy: The judgment is criticized for disregarding a previous 2022 Court of Appeal ruling that discharged Kanu, arguing that re-trying him violates the protection against double jeopardy under the 1999 Constitution.
Unsubstantiated Evidence: The conviction was based on evidence from five witnesses who were described as agents of the State Security Service (DSS) whose testimony was largely second-hand or hearsay.
The Defense has argued that the judgement is "legally dishonest" and a "constitutional ambush," which they believe will not survive appeal.
