UNDERSTANDING IMPORTANT LANDED DOCUMENTS IN REAL ESTATE
Before buying any land or property, it is imperative to understand the documents attached to it. These documents help to ascertain the authenticity, ownership, and security of the property.
Here are some landed documents and why they matter:
1. Certificate of Occupancy (C of O)
This is one of the most important land documents issued by the government. It proves that the owner has legal rights to occupy and use the land for a stated period of time. A land with a valid C of O is generally considered safer for investment.
2. Deed of Assignment
This document legally transfers ownership of land or property from the seller to the buyer. It contains details of both parties, property description, and agreed terms. Without it, ownership transfer may not be recognized legally.
3. Survey Plan
A survey plan shows the exact size, measurement, and location of the land. It also reveals whether the land falls under government acquisition or committed areas. It helps buyers avoid buying land in restricted zones.
4. Receipt
A land receipt is proof that payment was made for the property. While it is important, a receipt alone is not enough to prove ownership without supporting legal documents.
5. Sale Agreement
This is a written agreement between the buyer and seller stating the terms and conditions of the land transaction. It protects both parties before the final transfer documents are completed.
