A life sentence is meant to signal society’s strongest moral condemnation. When such a sentence is suspended, even temporarily, it forces us to confront uncomfortable questions about justice, power, and whose safety truly matters. On 23 December 2025, the Delhi High Court suspended the life sentence of Kuldeep Singh Sengar, convicted in the 2017 Unnao r**e case, and granted him bail after more than seven years of incarceration. The court reasoned that Section 5(c) of the POCSO Act, dealing with aggravated offences by a public servant, was prima facie not attracted and noted the long period already spent in custody while his appeal is pending. Bail was granted with conditions including a ₹15 lakh bond, a 5 km no entry zone around the survivor’s residence, and a complete bar on contacting her or her family. Legally, the order fits within the framework of appellate criminal jurisprudence. Suspension of sentence is not an acquittal. Courts are empowered to balance personal liberty, delay in hearing appeals, and statutory interpretation. But law does not operate in isolation. This case is not merely about sections and sub sections. It concerns a survivor who lived under sustained threat, a family that paid an irreparable price, and a struggle for justice that came to symbolise resistance against political impunity. When a convict in such a case is released on bail, even with safeguards, the message received by survivors across the country may differ sharply from the message the court intends to convey. Does prolonged custody outweigh the survivor’s continuing fear? Can procedural correctness truly coexist with substantive justice? And most importantly, does our system sufficiently centre the dignity and safety of victims once public attention fades? With the CBI and the survivor reportedly preparing to approach the Supreme Court, the legal battle is far from over. Yet the moral debate has already begun about accountability, deterrence, and whether justice in cases of sexual violence is experienced as closure or as an unending process for the survivor. **ecase
